Tax Attorney, A few reasons to hire one

Based upon our experience, these are the most common reasons why our clients hired a tax attorney.

1. You are afraid to deal with the New York State Tax Department or the Internal Revenue Service about your tax issue and you want a tax attorney to handle the matter. Our clients have the peace of mind knowing their case is being handled by a licensed professional with a tax law firm that has a A+ BBB rating. The insight we bring, and objective nature of our analysis of your tax case, is very useful to achieve the best results possible for you. We are very comfortable dealing with the IRS or NYS Tax Department. Benefits of hiring a tax attorney extend beyond mere paperwork; they provide strategic insights that can significantly reduce your tax liabilities. Furthermore, a tax attorney can advocate on your behalf, ensuring that your rights are protected throughout the entire process. This expertise can result in more favorable outcomes and a greater sense of security while navigating complex tax regulations.

2. The amount of taxes owed to the Internal Revenue Service or NYS Tax Department is over $20,000, or the IRS has assigned a Revenue Officer (collection person) to your case so you get the idea it makes sense to hire a tax attorney. The more back taxes you owe, the higher the stakes will be for you. Therefore, it is natural to hire a tax professional to handle your case. The IRS and NY State Tax Department will be more aggressive when large dollar amounts of taxes are owed, and this is especially true if the collection statute of limitations is expiring soon.

3. The Internal Revenue Service or New York State Tax Department has started to levy your assets (bank accounts, cars, etc). Correcting a levy requires a skill and time commitment that the typical taxpayer subject to this enforcement action does not usually possess.

4. You have many years of unfiled tax returns and therefore face potential criminal tax issues so a tax attorney may be able to help you. The ability of a tax attorney who is also a CPA is very helpful in these cases since one person can prepare the unfiled tax returns and also resolve or minimize the criminal exposure at the same time. Most taxpayers do not have the knowledge of past year tax laws and forms needed to file all the back tax years in an accurate manner. We also have the knowledge of how to minimize the criminal tax issues of unfiled tax returns, and typically we can handle the whole case without you needing to talk to either the IRS or NYS Tax Department.

5. You are being audited, and 1) you know that the numbers on the return are incorrect, or 2) feel uncomfortable dealing with the audit in general. Naturally, in both situations it would be best to have a "spokesman" tax expert handle this situation so you are not talking directly to the tax authorities.
